Following the U.S. Supreme Court's ruling on the Defense of Marriage Act, same sex spouses are eligible to receive tax-free health care coverage through an employer's Cafeteria Plan.

Beginning 2015, employers with 100 or more full-time equivalent employees face penalty taxes if their coverage doesn’t meet new federal requirements. In addition, employers with 50-99 full-time equivalent employees face the same penalties in 2016.
